Loupe End User License Agreement (EULA)
This Agreement sets forth the terms of use for Loupe (the “Software”). By installing or using the Software, you agree to be bound by this Agreement.
1. License Grant
The developer (Motoki Endo, the “Developer”) grants you a non-exclusive, non-transferable license to use the Software on macOS. The Software is licensed, not sold.
2. Restrictions
You may not:
- redistribute, rent, resell, or sublicense the Software;
- reverse engineer, decompile, or disassemble the Software or the bundled Sony Camera Remote SDK, except to the extent expressly permitted by applicable law;
- modify the Software or create derivative works of it, in whole or in part.
3. Third-Party Components
The Software uses the Sony Camera Remote SDK (provided by Sony Marketing Inc.). The license texts of the open-source software included in the SDK (libusb / libssh2 / OpenSSL) are available in the “About Loupe” screen.
4. Important Notice Regarding Camera Warranty
The Software controls your camera through the Sony Camera Remote SDK. Sony’s Camera Remote SDK license agreement stipulates that designated devices (such as cameras) used or operated through the Software fall outside the scope of Sony’s manufacturer warranty (Article 3 of that agreement). You acknowledge this by using the Software.
5. Restricted Uses
You may not use the Software or the designated devices (such as cameras) for military purposes (including, without limitation, the design, development, manufacture, or inspection of weapons or munitions, transport of hazardous materials, or intelligence, surveillance, and reconnaissance activities). The Software and the bundled Sony Camera Remote SDK are not designed for use in applications requiring a high degree of safety (such as the control of nuclear facilities, aircraft control or air traffic control, communication systems, life support systems, or weapons), and no warranty is made as to their fitness for such uses (disclosed pursuant to Article 7 of the Sony Camera Remote SDK license agreement).
6. No Warranty
The Software is provided “AS IS”. The Developer makes no warranty that the Software will operate uninterrupted or error-free, or that it is fit for a particular purpose. The Developer is not liable for loss of or damage to captured data or image files. Always keep backups of important data.
7. Limitation of Liability
To the maximum extent permitted by law, the Developer’s total liability for any damages arising out of the use of or inability to use the Software (including lost profits, data loss, business interruption, and damage to cameras or other equipment) shall not exceed the amount you actually paid for the Software.
8. Updates
The Software may deliver updates through an automatic update mechanism (Sparkle). This Agreement also applies to updates. The Developer may revise this Agreement; if a material change is made, you will be asked to agree again at the next launch.
9. Termination
This license terminates automatically if you breach any term of this Agreement. Upon termination, you must stop using the Software and delete all copies.
10. Governing Law
This Agreement is governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising from this Agreement.

Loupe エンドユーザー使用許諾契約書 (EULA)
本契約は、Loupe (以下「本ソフトウェア」) の使用条件を定めるものです。本ソフトウェアをインストールまたは使用した時点で、お客様は本契約に同意したものとみなされます。
1. ライセンスの許諾
開発者 (Motoki Endo、以下「開発者」) は、お客様に対し、本ソフトウェアを macOS 上で使用する非独占的かつ譲渡不能なライセンスを許諾します。本ライセンスは販売ではなく使用権の許諾です。
2. 禁止事項
お客様は、以下の行為を行うことはできません。
- 本ソフトウェアの再配布、貸与、転売、サブライセンス
- 本ソフトウェアおよび同梱の Sony Camera Remote SDK のリバースエンジニアリング、逆コンパイル、逆アセンブル (法令で明示的に認められる場合を除く)
- 本ソフトウェアの全部または一部の改変、二次的著作物の作成
3. サードパーティコンポーネント
本ソフトウェアは Sony Camera Remote SDK (ソニーマーケティング株式会社提供) を使用しています。同 SDK が含むオープンソースソフトウェア (libusb / libssh2 / OpenSSL) のライセンス原文は、アプリ内の「Loupe について」画面に記載しています。
4. カメラ保証に関する重要な通知
本ソフトウェアは Sony Camera Remote SDK を通じてカメラ本体を制御します。ソニーの Camera Remote SDK 使用許諾契約は、本ソフトウェアで使用・操作したカメラ等の指定デバイスが、ソニーの定めるメーカー保証の対象外となる旨を定めています (同契約第 3 条)。お客様はこれを理解した上で本ソフトウェアを使用するものとします。
5. 用途の制限
お客様は、本ソフトウェアおよびカメラ等の指定デバイスを、軍事用途 (武器・軍需品の設計、開発、製造、検査、有害物質の運搬、諜報・警戒監視・偵察活動等を含みますが、これらに限りません) に使用することはできません。また、本ソフトウェアおよび同梱の Sony Camera Remote SDK は、高度の安全性が要求される用途 (原子力施設の制御、航空機の制御・航空管制、通信システム、生命維持装置、兵器等) を想定して設計されておらず、これらの用途への適合性はいかなる保証もされません (Sony Camera Remote SDK 使用許諾契約 第 7 条に基づく説明事項)。
6. 無保証
本ソフトウェアは「現状有姿」で提供されます。開発者は、本ソフトウェアの動作が中断しないこと、エラーがないこと、特定目的への適合性について、いかなる保証も行いません。撮影データ・画像ファイルの損失または破損について、開発者は責任を負いません。重要なデータは必ずバックアップしてください。
7. 責任の制限
法令が許容する最大限の範囲において、本ソフトウェアの使用または使用不能から生じる損害 (逸失利益、データ損失、事業中断、カメラ等の機材の損傷を含む) について、開発者の責任総額は、お客様が本ソフトウェアに対して実際に支払った金額を上限とします。
8. アップデート
本ソフトウェアは自動更新機能 (Sparkle) を通じてアップデートを配信することがあります。アップデートにも本契約が適用されます。開発者は本契約を改定することがあり、重要な変更がある場合は次回起動時に再同意を求めます。
9. 契約の終了
お客様が本契約の条項に違反した場合、本ライセンスは自動的に終了します。終了後は本ソフトウェアの使用を中止し、複製物を削除するものとします。
10. 準拠法
本契約は日本法に準拠し、本契約に関する紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。
